Post-Conviction Relief

There are a number of post-conviction options available to you that can enable you to have a second chance and enjoy the opportunities denied you because of your criminal record. These include the following:

  • Misdemeanor Expungement

Infractions, misdemeanors and felonies can be expunged provided you only received probation and did not serve any state prison time. Also, your offense cannot have involved a sexual crime involving a minor. In some cases, even if you violated your probation, you may still be able to receive an expungement order. An expungement effectively dismisses your conviction and allows you to lawfully state under oath on most employment, rental housing and school applications that you have never been convicted of a crime.

  • Felony Expungement

As indicated, a felony can be expunged so long as you did not serve any state prison time and you have completed all the terms and provisions of your probation. If you did serve time in state prison, your other option is a Certificate of Rehabilitation. You may have to wait at least 7 years before applying but you are automatically eligible for a Governor’s Pardon and it does allow you to now apply for state and vocational licenses for which you were previously prohibited.

  • Early Probation Termination

Many probation periods are 3 or 5 years. Regardless of how long, though, after you have successfully served at least half of it, you may apply for early termination.   • Record Sealing

Another form of post-conviction relief pertains to sealing your arrest records or juvenile and drug diversion records. Arrest records may be sealed provided charges were either dismissed or you were never prosecuted. Under Herlong, California Penal Code Section 858.1, your arrest records may be sealed and not publicly accessible but only if a court determines that no reasonable cause exists to believe that you committed the offense for which you were charged. About Herlong

Herlong is a census-designated place in Lassen County, California. Herlong is located at the extreme Eastern edge of the Sierra Nevada Mountain Range in the southeastern region of Honey Lake Valley, 8 miles (13 km) north of Doyle, at an elevation of 4,114 feet (1,254 m). Herlong is located in southern Lassen County near the southeast edge of Honey Lake about 70 miles (110 km) north of Reno, Nevada, and about 45 miles (72 km) south of Susanville. The community is accessible to U.S. Route 395 via Lassen County Route A25 or Lassen County Route A26.

Herlong was built in 1942 to house civilian workers for Sierra Army Depot which was one of several ammunition storage facilities located far enough inland to be safe from Japanese attack. The site also met the requirement that the depot be in a dry and isolated area. Herlong was named after Captain Henry W. Herlong, the first United States Army ordnance officer to die in World War II. The postal stamps, money orders and equipment bore the spelling "Hurlong", which lasted for about five days, when the error was discovered and corrected. Sierra Army Depot now serves as the Army's End of First Life Center and the CONUS-based Army Prepositioned Stock Site while continuing to provide expeditionary logistics support and long-term sustainment solutions.

Since its beginning, the town has varied in size, peaking at about 5,000, in the 1950s (mostly civilian employees on the base), to the current population of 298 (at the 2010 census).

Herlong has several churches including the Bible Baptist Church, an Assembly of God church, and a Southern Baptist church. The Office of Historic Preservation currently lists 62 historic properties in Herlong on its Historic Properties Data File for Lassen County, one of the last counties in the American west that is still considered "open range" land.
