Expunging Your Conviction

Expungement in Las Vegas, New Mexico does not mean the destruction of your records since law enforcement and the courts will retain these records to be used under certain circumstances. It does, though, enable the court to reopen your case and dismiss your conviction provided certain conditions have been met. Post-Conviction Relief

There are a number of post-conviction options available to you that can enable you to have a second chance and enjoy the opportunities denied you because of your criminal record. These include the following:

  • Misdemeanor Expungement

Infractions, misdemeanors and felonies can be expunged provided you only received probation and did not serve any state prison time. Also, your offense cannot have involved a sexual crime involving a minor. In some cases, even if you violated your probation, you may still be able to receive an expungement order. An expungement effectively dismisses your conviction and allows you to lawfully state under oath on most employment, rental housing and school applications that you have never been convicted of a crime.

  • Felony Expungement

As indicated, a felony can be expunged so long as you did not serve any state prison time and you have completed all the terms and provisions of your probation. If you did serve time in state prison, your other option is a Certificate of Rehabilitation. You may have to wait at least 7 years before applying but you are automatically eligible for a Governor’s Pardon and it does allow you to now apply for state and vocational licenses for which you were previously prohibited.

  • Early Probation Termination

Many probation periods are 3 or 5 years. Regardless of how long, though, after you have successfully served at least half of it, you may apply for early termination.   • Reducing Your Felony to a Misdemeanor

In many instances, a felony can be later reduced to a misdemeanor pursuant to Penal Code Section 17(B). This would include those offenses considered “wobblers” wherein the district attorney has the discretion to charge you with either a felony or misdemeanor. Reducing your conviction to a misdemeanor restores your right to possess and own firearms for example and can eliminate potential immigration problems.   • Record Sealing

Another form of post-conviction relief pertains to sealing your arrest records or juvenile and drug diversion records. Arrest records may be sealed provided charges were either dismissed or you were never prosecuted. Under Las Vegas, New Mexico Penal Code Section 858.1, your arrest records may be sealed and not publicly accessible but only if a court determines that no reasonable cause exists to believe that you committed the offense for which you were charged. Prosecutors have discretion whether to charge you though there may be evidence that seemingly appears sufficient to link you to the crime. If a judge feels that there was probable or “reasonable” cause to believe you committed the crime regardless if you were charged, then your arrest records may not be sealed. Juvenile records are often not available to the general public but it is worthwhile to have them sealed nonetheless to avoid any potential problems you may encounter as an adult. You must be at least 18 years old, or the juvenile court’s jurisdiction ended at least 5 years earlier, did not commit any crimes involving moral turpitude and have no pending criminal charges, and you present evidence of rehabilitation.

Drug diversion is available usually for first time offenders charged with possession. Once you successfully complete all terms and conditions in the diversion program, you can petition the court to have your arrest and other records sealed.

About Las Vegas

Las Vegas is a city and county seat of San Miguel County, New Mexico, United States. Once two separate municipalities (one a city and the other a town) both named Las Vegas, west Las Vegas ("Old Town") and east Las Vegas ("New Town"), separated by the Gallinas River, retain distinct characters and separate, rival school districts. The population was 14,565 at the 2000 census. Las Vegas, NM is located 110 miles south of Raton, New Mexico, 65 miles east of Santa Fe, New Mexico, 122 miles northeast of Albuquerque, New Mexico, 257 miles south of Colorado Springs, Colorado, and 326 miles south of Denver, Colorado.

Las Vegas was established in 1835 after a group of settlers received a land grant from the Mexican government. The town was laid out in the traditional Spanish Colonial style, with a central plaza surrounded by buildings which could serve as fortifications in case of attack. Las Vegas soon prospered as a stop on the Santa Fe Trail. During the Mexican-American War in 1846, Stephen W. Kearny delivered an address at the Plaza of Las Vegas claiming New Mexico for the United States. In 1877 Las Vegas College, the precursor to Regis University, was founded in Las Vegas by a group of exiled Italian Jesuits. In 1887, Las Vegas College moved to Denver whereupon the name was changed.

A railroad was constructed to the town in 1880. To maintain control of development rights, it established a station and related development one mile (1.6 km) east of the Plaza, creating a separate, rival New Town (as occurred elsewhere in the Old West. The same competing development occurred in Albuquerque, for instance). During the railroad era Las Vegas boomed, quickly becoming one of the largest cities in the American Southwest. Turn-of-the-century Las Vegas featured all the modern amenities, including an electric street railway, the "Duncan Opera House" at the northeast corner of 6th Street and Douglas Avenue, a Carnegie library, a major Harvey House hotel, and the New Mexico Normal School (now New Mexico Highlands University). Since the decline and restructuring of the railroad industry began in the 1950s, the city's population has remained relatively constant. Although the two towns have been combined, separate school districts have been maintained (Las Vegas City Schools and West Las Vegas School District).

Historian Ralph Emerson Twitchell once claimed regarding the Old West, "Without exception there was no town which harbored a more disreputable gang of desperadoes and outlaws than did Las Vegas."

As of the census of 2000, there were 14,565 people, 5,588 households, and 3,559 families residing in the city. The population density was 1,938.2 people per square mile (748.8/km²). There were 6,366 housing units at an average density of 847.1 per square mile (327.3/km²). The racial makeup of the city was 54.21% White, 0.99% African American, 1.96% Native American, 0.61% Asian, 0.10% Pacific Islander, 37.19% from other races, and 4.95% from two or more races. Hispanic of any race were 82.94% of the population.
